Lexington County, South Carolina (2021) Mr. Myers as lead attorney along with co-counsel Ralph Kennedy obtained a record verdict after turning down an offer to settle the case for $50,000 in a counterclaim where an 80-year-old man suffered cracked ribs and cracked vertebrae. Our client was injured when his vehicle while making a left turn was t-boned by a speeding driver. The other driver denied fault and sued our client. We showed the other drivers speed and reckless driving caused the collision. After a four-day trial, the jury found the plaintiff at fault and awarded our client $589,025.29. In addition to special damages, the Jury awarded $150,000 for pain and suffering, $150,000 for loss of quality of life, $180,000 for loss of consortium to the man’s wife and $50,000 in punitive damages due to the reckless driving of the plaintiff.

Medical Malpractice Settlement

Savannah Georgia – Our clients were a young couple who tragically lost their first child when an attending OB-GYN and other hospital staff failed to provide adequate and proper care and monitoring of labor and delivery. Orangeburg, South Carolina – Mr. Myers obtained a $900,000 settlement on behalf of the estate of a woman who died as a result of a cancerous skin lesion that went un-biopsied for approximately 4 years, despite over 20 doctor visits and numerous treatments of the lesion by the dermatologist with liquid nitrogen and steroid injections. The cancerous lesion ultimately metastasized to the client’s lungs, leading to a painful death. Mr. Myers were successful in showing that had a simple biopsy been performed or the lesion been simply removed within the first two years of treatment, the cancer would not have spread, and the client would not have died.

Rock Hill, South Carolina – Mr. Myers tried this pharmacy misfill case in front of a jury to receive an award of $15 million actual and punitive damages for a brain-injured child and $1.02 million for her parents. The young child was given a diabetic medication instead of the Ritalin she was supposed to receive for ADHD. She lapsed into a coma and suffered brain damage affecting her ability to learn. The verdict was upheld on appeal to the SC Court of Appeals (Hundley v. Rite-Aid, 529 S.E.2d 45), and thereafter settled while pending before the South Carolina Supreme Court for over $24,000,000.
